1. Introduction
This Privacy Policy ("Policy") describes how Market of Everything, LLC ("Company," "we," "us," or "our") collects, uses, discloses, and safeguards information in connection with the Moe mobile application and related services (collectively, the "Service"). This Policy applies to all users of the Service ("you" or "your").
We are committed to protecting your privacy. By creating an account or otherwise using the Service, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use the Service.
2. Information We Collect
We collect the following categories of information.
2.1 Information You Provide. When you register for an account, we collect your name and email address. When you contact us for support or otherwise communicate with us, we collect the information contained in those communications.
2.2 Marketplace Account Credentials. The Service enables you to connect third-party marketplace accounts (such as eBay and Depop) so that the Service may create listings and perform other actions at your direction (each, a "Connected Account"). Depending on the marketplace, we connect to your Connected Account either through industry-standard authorization protocols, in which case we store a revocable access token rather than your password, or by storing the access credentials you provide. Where we store credentials directly, they are encrypted. Section 6 describes how this information is secured.
2.3 Payment Information. When you make a purchase, payment is processed by our third-party payment processors. Purchases made within the Service are processed by the Apple App Store or Google Play, and direct card payments are processed by Stripe, depending on the payment method you select. We do not collect or store complete payment card numbers. We may retain transaction records, including the date, amount, and a partial card identifier such as the last four digits.
2.4 Location and Device Information. We collect device and technical information, including device model, operating system version, unique device identifiers, mobile network information, and IP address. We may collect approximate or precise location information where you have granted the applicable permission.
2.5 Usage and Diagnostic Information. We automatically collect information about how you interact with the Service, including features accessed, listings created, session duration, and crash and performance diagnostics, through our analytics provider, PostHog.
3. How We Use Information
We use the information we collect to:
(a) provide, operate, maintain, and improve the Service;
(b) authenticate you and connect to and act upon your Connected Accounts as you direct;
(c) process transactions and deliver related confirmations and receipts;
(d) respond to your inquiries and provide customer support;
(e) monitor and analyze usage, trends, and performance;
(f) detect, investigate, and prevent fraud, security incidents, and violations of our terms;
(g) comply with applicable legal obligations and enforce our agreements.
4. How We Disclose Information
We do not sell your personal information. We disclose information only as described below.
4.1 Service Providers. We share information with vendors who perform services on our behalf, such as cloud hosting, analytics, and payment processing, subject to obligations of confidentiality and limited use.
4.2 Connected Marketplaces. When you direct the Service to act on a Connected Account, we transmit the information necessary to perform that action to the applicable marketplace.
4.3 Legal and Safety. We may disclose information where we believe in good faith that disclosure is necessary to comply with applicable law or legal process, to enforce our agreements, or to protect the rights, property, or safety of the Company, our users, or others.
4.4 Business Transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.
5. Connected Accounts and Marketplace Authorization
When you connect a marketplace account, you authorize the Service to access that account and to take the actions you request, such as creating, editing, and managing listings. You may disconnect a Connected Account at any time through the Service's account settings. Upon disconnection, we revoke the associated access token or delete the stored credentials, as applicable.
Your use of each connected marketplace remains governed by that marketplace's own terms and privacy practices. We are not responsible for the policies or practices of third-party marketplaces, and connecting an account through the Service does not alter your direct relationship with those marketplaces.
6. Data Security
We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit using Transport Layer Security and encryption at rest. Marketplace credentials stored directly by the Service are encrypted at rest, and access to them is restricted to the systems and personnel necessary to operate the Service.
No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your information using commercially reasonable means, we cannot guarantee its absolute security.
7. Data Retention
We retain personal information for as long as your account remains active or as necessary to provide the Service, and thereafter as required to comply with our legal obligations, resolve disputes, and enforce our agreements. We delete or de-identify information when it is no longer required for these purposes. Credentials and access tokens associated with a Connected Account are deleted or revoked upon disconnection of that account or deletion of your account.
8. Your Rights and Choices
You may access, update, or correct your account information within the Service. You may disconnect any Connected Account, and you may request deletion of your account and associated personal information by contacting us at the address in Section 12. You may also manage location and notification permissions through your device settings.
Depending on your jurisdiction, you may have additional rights regarding your personal information, including the rights to access, delete, and restrict certain processing of that information. We will honor such rights as required by applicable law. Where the California Consumer Privacy Act applies to us, California residents may exercise the rights it provides, and we will not discriminate against you for exercising those rights.
9. Children's Privacy
The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information promptly.
10. Third-Party Links and Services
The Service may contain links to or integrations with third-party websites and services that we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.
11. Changes to This Policy
We may update this Policy from time to time. When we make material changes, we will notify you through the Service or by other reasonable means and will revise the "Last Updated" date above. Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Policy.
